1. Acceptance of Terms
By accessing or using the GiveNet platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Platform. We reserve the right to update these Terms at any time with notice.
2. Eligibility
You must be at least 16 years old to use GiveNet. By registering, you represent that you are at least 16 and have the legal capacity to enter these Terms. Organizations must be legitimately registered.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You are fully responsible for all activities under your account. Notify us immediately of any unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Donations and Requests
Donors represent that they have full legal right to donate the listed items. Items must be legal, safe, and accurately described. Misrepresentation is grounds for account suspension. GiveNet does not guarantee that any donation will be matched or that any request will be fulfilled. All exchanges are between users — GiveNet is a facilitator only.
Prohibited items include: weapons and ammunition, controlled substances, alcohol, tobacco, counterfeit or stolen goods, expired or unsafe food, animals, and any illegal items.
5. User Conduct
You agree not to: post false or misleading information, harass, abuse or harm other users, attempt to circumvent the platform's matching or verification systems, use automated scripts or bots, collect other users' personal data without consent, or attempt to use the platform for commercial profit.
6. Intellectual Property
GiveNet and its logo are trademarks of the GiveNet platform. The content you post remains yours; by posting it you grant GiveNet a non-exclusive, royalty-free licence to display, distribute and use it to provide the service.
7. Limitation of Liability
GiveNet is provided "as is" without warranties of any kind. To the maximum extent permitted by law, GiveNet shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Platform, any exchanges between users, or the quality, safety, or legality of donated items.
8. Dispute Resolution
Any disputes between users should first be reported to GiveNet via the flagging system. GiveNet may mediate but is not obligated to resolve user disputes. Legal disputes shall be governed by the laws of Kenya.
9. Termination
We may terminate or suspend your account at any time for violation of these Terms, fraudulent activity, or any other reason at our sole discretion. Upon termination, your right to use the Platform ceases immediately.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or in-platform notification. Continued use after changes constitutes acceptance.
